Working as a promoter I have come crossways many different cut offs all with different demands in them for riders, feed and drinks and even special requirements.
I have in the past times managed to negotiated with doers and artists lower fees for performance if the gig has been free entry, if the gig has been a paid night sometimes artist require a verses know typically 80/20 split in the artist favor. This is usually if the artist is very confident they result sell disclose the venue. I how ever have of all time preferred to do a set fee deal with the artist and some artists also prefer this type of deal.
The just about recent contract I have used or been given is a performance contract for a border playing at my Cadence Festival.
One of the most discernible lines is the opening couple of lines :

This performance compact is made and entered into by and between:
Promoter: ........................
This clearly shows who the contract is between so this performer and the promoter of the venue and so forming a binding agreement between the 2 parties.
This makes certain that the promoter is getting the artist that he is passing to entrust on and promote to audience. As contract could come from an agent it makes sure that the promoter is sure who he has booked and going to tell his clientele who are playing.
I have been caught out in the past by not using a contract and a different artist tuning up to play, as I had not put a contract in place there was nothing I could do. luckily I had put on the posters subject to change and it was a free entry gig.
